1. Overview

Metro Surgery Staffing LLC (“MSS,” “we,” “our,” or “us”) operates a staffing marketplace connecting outpatient medical facilities (“Facilities”) and independent perioperative clinicians (“Clinicians”) in Michigan (the “Platform”). This Privacy Policy explains how we collect, use, share, and protect personal information. By using the Platform, you consent to this Policy.

2. Information We Collect

a. Account Information

  • Name, email, phone number
  • Licenses/credentials (Clinicians); facility name, address, contact (Facilities)
  • Payment and tax details as needed for payouts, invoices, and 1099 reporting

b. Timekeeping & Shift Data (Clockify)

We use a third-party timekeeping provider (currently Clockify) to record hours worked. We receive time entries (start/stop, tags, notes) for verification, invoicing, and payouts.

c. Background Checks (Checkr)

If required, background screening is processed by Checkr, Inc. Checkr’s independent privacy practices apply.

d. Payments (Stripe)

Payments and payouts are processed through Stripe (“Stripe”). MSS does not collect or store your full payment credentials. Stripe’s secure payment platform handles financial information directly and provides MSS only with confirmation of completed transactions and limited identifiers (e.g., last four digits, payment method type, transaction references) necessary for accounting and compliance.

e. Automatically Collected Data

  • IP address, device identifiers, browser/OS info
  • Cookies and similar technologies for session management and analytics

We do not sell or rent personal information to third-party marketers.

3. How We Use Information

  • Operate, maintain, and secure the Platform
  • Match Facilities with qualified Clinicians and verify credentials
  • Process payments, invoices, and payouts
  • Communicate shift details, updates, and support messages
  • Comply with legal, tax, and audit obligations
  • Improve services and prevent fraud or misuse

4. Information Sharing

  • With Facilities: Relevant Clinician profile/credential info and verified shift data
  • With Clinicians: Facility name, location, and shift details
  • With Service Providers: Vendors (e.g., Clockify, Checkr, Stripe) under data-processing or service agreements that require confidentiality and security of your information.
  • With Authorities: If required by law, subpoena, or governmental request
  • Business Transfers: In a merger, acquisition, or asset sale, data may transfer as part of the business

5. Data Retention

  • Shift/time and payment records: 7 years (tax/audit)
  • Clinician credentials: while account is active and up to 2 years after closure
  • Background checks: kept only as legally required or until verification is complete

We may retain limited information to comply with law, prevent fraud, or resolve disputes.

6. Security

We implement administrative, technical, and physical safeguards, including HTTPS/TLS, role-based access, and vendor security reviews. No system is perfectly secure. MSS complies with Michigan’s Identity Theft Protection Act (MCL 445.61 et seq.) and will provide required notices in the event of a data breach involving personal information.

All payment data transmitted through Stripe is encrypted and stored only by Stripe in accordance with applicable security standards; MSS never stores full payment card numbers or complete bank account and routing numbers on its systems.

7. HIPAA & PHI

MSS is not a healthcare provider and is not a HIPAA business associate unless expressly agreed in writing. The Platform is not designed to store or transmit Protected Health Information (PHI). Do not enter PHI other than minimal scheduling details necessary for staffing logistics.

8. Children’s Privacy

The Platform is intended for licensed adults (18+). We do not knowingly collect data from minors.

9. Your Rights & Choices

  • Access or correct personal information you provided
  • Request account deletion (subject to legal retention requirements)
  • Opt out of non-essential communications

10. Data Transfers

We operate in the United States. If you access the Platform from outside the U.S., you consent to the transfer and processing of your information in the U.S. under this Policy.

11. Updates to This Policy

We may update this Policy periodically. When we do, we will revise the “Effective Date” above and post the updated version. Continued use of the Platform after updates constitutes acceptance of the revised Policy.
